My first thread after a long hiatus, the above title pertains to a recent discovery within the Halo 2 Anniversary terminals.

As many of you are aware I created a Halo shp scale chart back in 2010 that contained a mix of the iconic ships spanning across the UNSC, Covenant, Forerunner fleets including this little gem-

This is of the Covenant Battle Station Unyielding Hierophant featured in the novel Halo: First Strike and was only given a brief description of its appearance- 30km long and looked like two squids kissing, that was the only clue to this stations appearance and hasen't been visually revealed in any canon form, until now-

Unikraken was kind enough to bring this to my attention and I have to say I am a little disappointed in 343I, I'd always believed that when I made the scale chart and considered the reasons for the designs that the official canon version (should it ever appear) would staggeringly out class my own design y'know because its from the guys that MAKE Halo and not copy a fan's attempt.

So as the title of the thread says should I be upset or flattered by this, or maybe I should keep quiet and accept the complement :unsure: ?

 

BTW the above color image was not made public before hand which explains the minor aesthetic differences. Also had I known I had the potential to influence canon design I'd have made the chart a few years earlier and possibly saved us all from that god awful lazy attempt of a 27km long,  insert ship that cannot be named here  with my own more unique and carefully considered design.

I guess you could be both and I see no reason why you shouldn't. Considering they liked your design more than anything they could come up with is quite a compliment. The fact there is no (or atleast there doesn't seem to be any) credit to you is lame to say the least. However 343i doesn't have to, according to the content usage rules. This is something Sancho, Waseem and I have discussed in lenght (and depth) over the years. Unikraken has joined us in many occassion. It's these kinds of corporate shit that just discourages me of even trying to come up with something original to use in mods (like original soundtracks, or in your case designs, models and what not). 

 

On the other hand it's also a huge opportunity. If you have a date (which is kinda important on the internet to prevent acusations of 'ripping off original work') displayed with the original post, you can advertise yourself as the designer of the Unyielding Hierophant and see where that goes. I am not sure how 343i would react to that, since they could send you a C&D (does that even apply here?). But if you have the balls to do it, I certainly would. Who knows what kind of awesome career awaits?

Might be because I'm calling it the Unyeilding Heirophant from Halo, if from the beginning I'd made it for an original IP of my own making then it would be blatent theft on their part, lets not forget the homefront super carrier that ended up in the halo comic.

If you make anything within, or in this particular case add, something to the Halo universe it has to be within or based on the Game Content Usage Rules. And these rules specifically cite:

Distribution of your Item in any form constitutes a grant by you of a royalty-free, non-exclusive, irrevocable, transferable, sub-licensable, worldwide, license to Microsoft and any of Microsoft's partners or users to use, modify and distribute that Item (and derivatives of that Item), and use your name if we choose to, for any purpose and without obligation to pay you anything, obtain your approval, or give you credit.  And this license to Microsoft survives any termination or expiration of these Usage Rules.  This means that if you add to the game universe or expand on the story told in the game with "lost chapters" or back story or anything like that, distribution of your story or idea may appear in a future game without any compensation to you. (Sorry, but our lawyers tell us we need to do this in order to avoid frivolous lawsuits getting in the way of making more great games.) It also means we can put your Item on a Microsoft site or property like Halo Waypoint if we want to.  

 

It doesn't prohibit you from stepping up and showing everyone you're the original creator. As long as you don't drag Microsoft to court.

As long as you can prove it you can definitely put it on a resume that you made the concept art to the Unyielding Hierophant.

Bungie and 343I both have a history of taking things from the community and using them. I would probably just be happy they liked the work and see if you can get someone to acknowledge you.

I'm pretty sure this has not held up in court when it has been put to the test in the past. I vaguely recall reading here there was one incident of a ship being used either on a novel cover or in a comic and the original fan creator caused a ruckus.

Yeah, they used a render he'd made on a book cover for a Star Trek book and they had to pay him.

Unfortunately anything you make that is tied to Halo doesn't belong to you so even if you claimed it a your original work you couldn't do anything with it because its not yours anymore. Kind of disappointed really, your station is extremely lackluster and has no detail to it. This was cord by that comic studio that did the CEA stuff so I can see why they would draw a blank here but still.

This is iffy in court. However, if you want to try it you had better have the resources, if you do they will likely try and settle out of court to keep a judge from going through those rules line by line. There have been cases were original creators have gotten paid for stuff like this because they threatened to go to court despite content usage rules. Because in many cases they don't hold up to the law. That being said if you try you want the resources particularly with M$.

Given the fact that I still won't look at it for spoilers, I'd be quite, quite pissed off if they used something of mine and didn't even care to give me credit, even if just a name at the end of the credits with "Special Thanks to".

I've checked back though my gallery, march 27th 2011 was the posting date of the BW version with the original chart itself being September 7th 2010, if a Deviant Art time stamp is any validation, I do agree Zero the design is lacking a lot of its detail but the purpose of the design was to give a general idea of its look and shape, don't think I even settled on a final design, though I do remember wanting to keep it closer to High Charity's look as both would have been built by the Covenant and have similarities. Guess 343 didn't seem to mind the lack of detailwhen they used it.

No it's not iffy. There is a EULA and GCUR for a reason. They have used it for C&D's in the past. It specifically states their IP is theirs. Now if Darkstorm had said it wasn't from Halo and they used, then by all means. But because he directly tied it to the franchise, Microsoft owned it the second he uploaded it.

Well that's pretty neat to me, I sort of struggled imagining what that station looked like and I read the First Strike years ago. It would look odd for say, the Covenant Starbase, especially if you allowed it to move like the current one does. But each to their own.
